These Terms of Service ("Terms") govern your use of the PollenPath mobile application ("the app," "we," "our"). By downloading, installing, or using PollenPath, you agree to these Terms.

1. Acceptance of Terms

By using PollenPath, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the app.

2. Description of Service

PollenPath is a wellness and tracking application that allows you to:

Log allergy symptoms and store them in Apple HealthKit
View pollen levels, air quality, and weather conditions for your area
Discover personal symptom patterns and environmental correlations
Receive alerts about high pollen conditions

The information displayed in the app — including pollen levels, air quality data, symptom correlations, and trend insights — is for informational purposes only. Always consult a qualified healthcare professional before making decisions about your health, medication, or treatment.

3. Eligibility

PollenPath is available to users of all ages (rated 4+). If you are under the age of majority in your jurisdiction, you should review these Terms with a parent or guardian.

4. User Responsibilities

You are responsible for granting appropriate permissions (HealthKit, location, notifications) for the app to function
You are responsible for the accuracy of symptom data you log
You must not attempt to reverse-engineer, decompile, or tamper with the app
You must not use the app for any unlawful purpose

5. Subscriptions & Purchases

5.1 Plans

PollenPath offers three tiers:

Free: Symptom logging, weather data, Apple Health integration
Basic: Daily pollen index, air quality data
Pro: 5-day pollen forecast, species-level detail, personalized insights

5.2 Billing

Subscriptions are billed through your Apple ID via the App Store
Monthly and yearly subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
Lifetime purchases are one-time payments with no recurring charges
Prices are displayed in your local currency in the App Store and may vary by region

5.3 Cancellation & Refunds

You can cancel your subscription at any time via App Store Settings > Subscriptions
Cancellation takes effect at the end of the current billing period — you retain access until then
Refund requests are handled by Apple per their refund policy

5.4 Price Changes

We may change subscription prices. Apple will notify you of price changes in advance, and you will have the option to accept or cancel before the new price applies.

6. Data & Privacy

Your privacy is important to us. Please review our Privacy Policy for details on how we handle your data. Key points:

Health data is stored only in Apple HealthKit on your device
Location data is rounded to city level before external API calls
No analytics, tracking, or advertising
You can delete all app data at any time

7. Intellectual Property

PollenPath and all its content — including but not limited to design, code, graphics, icons, and text — are owned by PollenPath and protected by copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works without written permission.

8. Third-Party Services

PollenPath relies on third-party services for environmental data:

Google Pollen API and Air Quality API: Subject to Google's Terms of Service
Apple WeatherKit: Subject to Apple's Terms

We are not responsible for the accuracy, availability, or reliability of third-party data. Pollen and air quality information may be delayed, incomplete, or unavailable in certain regions.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

PollenPath is provided "as is" and "as available" without warranties of any kind, express or implied
We do not warrant that pollen, air quality, or weather data will be accurate, complete, or available at all times
We are not liable for any health decisions made based on information displayed in the app
We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the app
Our total liability shall not exceed the amount you paid for the app in the 12 months preceding the claim

10. Indemnification

You agree to indemnify and hold harmless PollenPath from any claims, damages, or expenses arising from your use of the app or violation of these Terms.

11. Modifications

We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of the app after changes constitutes acceptance of the updated Terms.

12. Termination

You may stop using PollenPath at any time by deleting the app. We reserve the right to suspend or terminate access to the app if you violate these Terms.

13. Governing Law

These Terms are governed by the laws of the jurisdiction in which you reside, without regard to conflict of law provisions. Any disputes shall be resolved in the courts of that jurisdiction.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force and effect.
